End user License agreeement

Please read this agreement carefully. By purchasing and downloading any track from Filmtv-tracks library, you ( licensee ) hereby agree to and are bound by the terms and conditions of this end user agreement.

When you purchase an mp3 or cd from Filmtv-tracks, our products are licensed, not sold, to you by Filmtvtracks, for commercial use in corporate videos, tv and radio broadcasts, multi-media presentations, animations, on-hold messaging, and trade shows.

You may Transfer the music in synchronization to any medium necessary (video, film, reel to reel, digital, etc.) to complete your commercial or non-commercial production without any additional licensing fees.
You may produce and sell a product that contains music from the Film-tvtracks library without any additional licensing fees providing the end user of your product is restricted from obtaining direct access to the music for personal use.
The music may not be used unaccompanied or as a solo item, or incorporated into other music catalogues or any device capable of reproducing the music as a solo item.

You must give proper credit to the composer with: all copyrights, licensing, duplication and distribution rights are held exclusively by Filmtv-tracks and file proper cue sheets with the appropriate rights agencies (ie ASCAP, BMI, and SESAC).

Use in major theatrical releases or in mass-market retail distribution (3.000+ units) is licensed separately by contacting Dan Foster

Broadcast (Network, public, cable) of this music is cleared through the performing rights society BMI, ASCAP, SOCAN, PRS, SACEM, whose revenues are collected directly from broadcast station licensing, not from you as a producer. If your production is to be broadcasted, you are required to file a cue sheet with BMI or ASCAP.

Filmtv-tracks music is protected by international copyright laws.

Filmtv-tracks grants you a perpetual, non-exclusive, non-transferable, one (1) User license to use the Content only as provided in this License Agreement. Licenses for multiple-site use and mass-market distribution are sold separately .

PERMITTED USES

You may synchronize the Audio Material with audio and/or visual productions or applications such as:

Films, trailers, games and other multimedia projects, Training and marketing presentations, Corporate videos, conventions, business meetings, On-hold messages, Web pages, Interactive programs ( software or video ), Computer games, All public exhibitions: lobbies, storefronts, museum displays, kiosks, etc.

PROHIBITED USES

You may NOT:

LIMITED WARRANTY
Filmtvtracks warrants the mp3, compact disc or dvd on which the music is recorded to be free from defects in materials and workmanship under normal use for a period of two (2) years. We will replace the mp3 or CD to the original owner if he or she returns the faulty product to Filmtvtracks . Filmtv-tracks cannot guarantee, however, that the music contained on the music volumes will meet your specific requirements.

GENERAL
You acknowledge that you have read this agreement, understand it, and agree to its terms and conditions. Non compliance with the terms of this agreement or failure to pay relevant invoices for the music on time will render our licensing agreement void.
